**US Army sergeant found guilty of killing BLM protester in Austin**

Texas Army Sergeant Convicted of Killing Black Lives Matter Protesters in 2020
 US Army Sergeant **Daniel Perry** was convicted on Friday of murdering Black Lives Protester **Matter Garrett Foster** in 2020, but acquitted of aggravated assault with a deadly weapon. The Travis County District Attorney’s Office (TCDA) jury found Perry guilty of murder but acquitted him of aggravated assault with a deadly weapon after shooting at a protest on July 25, 2020. According to CBS Austin, the prosecution argued that Perry provoked a group of marching protesters as he drove through a red light during a demonstration. “Garrett Foster had a right to go and see what was going on,” the prosecutor said. “And he had every right to do it with his deadly weapon, his rifle, because [Perry] He was in a deadly weapon, his car.

According to the Austin American-Statesman newspaper, Perry’s lawyer defended himself in self-defense, claiming that 28-year-old Foster had first lifted his AK-47 rifle. Witnesses testified that Foster never lifted his gun before Perry fired five shots and hit Foster multiple times. The defense said, “It’s fine to feel sorry for Garrett Foster, but Garrett Foster made a decision that night. According to CBS, he came prepared for war, not for a protest. The prosecutor presented evidence refuting Perry’s claim that the crowd had occupied his car, and social media posts belittling protesters and discussing how someone in Texas could get away with shooting them.

According to The Statesman, Garrett’s father, Stephen Foster, said outside of court that his family was “satisfied with the decision and very sorry for[Perry’s]family.”

A charge of lethal conduct against Perry is pending.
