Dustin John Higgs is a federal prisoner who was scheduled to be executed just days before President-elect Joe Biden takes office and tested positive for coronavirus. The Bureau of Prisons notified Dustin John Higgs’ attorneys Thursday that his client had tested positive for the virus.

The revelation from Higgs’ attorney Devon Porter comes amid concern over a growing number of coronavirus cases in the federal prison system and specifically at the compound in Terre Haute, Indiana, where the executions are taking place. He is the only federal death row.

Dustin John Higgs is scheduled to be executed on January 15, just five days before the death penalty opponent Joe Biden takes office. His diagnosis marks the first known case of coronavirus on federal death row and raises the possibility that a judge will delay his execution if his condition deteriorates.

Higgs is the latest of those currently scheduled to be executed in a series of federal executions that began in July.

His execution date follows the massive controversy last week surrounding the death of Brandon Bernard, who was given a lethal injection of phenobarbital in the same federal prison. Bernard was 18 when he and four other teenagers kidnapped and robbed Todd and Stacie Bagley on their way from a Sunday service in Killeen, Texas, in 1999. The couple was shot and killed and then their car was set on fire.

The Supreme Court denied a last-minute appeal to stop Bernard’s death despite a plea from reality star turned inmate rights activist Kim Kardashian.

Kim Kardashian lashed out at the US justice system, calling it “screwed up,” after the federal government went ahead with the execution.

The attorneys for Dustin John Higgs have previously raised concerns about the possibility that their client will contract the virus and may present complex health issues prior to execution. The Bureau of Prisons (BOP) confirmed in a statement that inmates on federal death row, known as the Special Confinement Unit, tested positive for COVID-19.

The BOP also said that a contact tracing investigation revealed that an employee working at the unit had also tested positive for the virus.

One of Higgs’s attorneys, Shawn Nolan, said: “This is certainly the result of the super spreader executions that the government was quick to undertake in the heart of a global pandemic. “Now our client is sick.”

As of Thursday, there were more than 300 inmates with confirmed COVID-19 cases among FCC Terre Haute inmates.

The Bureau of Prisons said that “many of these inmates are asymptomatic or have mild symptoms.”

Two other executions are scheduled at the prison complex in the days leading up to Higgs’ execution.

Higgs was convicted of ordering the 1996 murders of three women, Tamika Black, Mishann Chinn and Tanji Jackson, at a federal wildlife center near Beltsville, Maryland. Higgs and two others kidnapped the women after Higgs was enraged that one of the women rejected his advances at the party.
