Court documents say Miller posted a video on Twitter (his account has since been suspended) on the night of January 6 “From Inside Congress.” The 14-second video “goes through a crowd inside the Rotunda of the US Capitol, waving pro-Trump and American flags,” said the feds.
That same day, officials allege that Miller responded to an AOC tweet that read: “We acted with honor and we were not armed. We were nice to the police. They
murdered a child. “In a direct follow-up tweet, he said,” Kill AOC. ”
Days after the siege, Miller allegedly said he “had a rope in [his] bag from him that day,” in a post on Instagram.
In addition to the threat made against the New York representative, the feds say Miller posted on Facebook 10 days after the site to say that the Capitol officer who shot and killed Ashli Babbitt “deserves to die.” A few days earlier, Miller reportedly said: “We will contact [the USCP officer] and hug him around the neck with a good piece of string.”
One of Miller’s final Facebook posts he referenced in the complaint said he was “happy to make death threats” online and was “happy to be banned” from Twitter.
In what has become a common trend among many of the suspected rioters of the January 6 uprising, the FBI says Miller largely documented his involvement, including his preparations before arriving in Washington, D.C.

An attorney representing Miller told CNN on Saturday that his client “certainly regrets what he did.”
“He did it in support of former President (Donald) Trump, but he regrets his actions. He has the support of his family, and many of the comments, viewed in context, are actually some kind of misguided political hyperbole. Given the political divide these days, there is a lot of hyperbole, “said Clint Broden.
