Jose Rosas Olivo, a father in Washington was arrested and charged with killing his 5-week-old young son after prosecutors said he spent weeks intentionally inflicting pain and torturing the boy until he died.

The Benton County Prosecutor’s Office on Wednesday charged Jose L. Rosas Olivo, 28, with one count of manslaughter and murder in the first degree in the death of his newborn son, identified in court documents as JR, The Tri-City Herald reported.

According to the report, Olivo took his son to Kadlec Medical Center in Richland on the morning of September 24. The victim was pronounced dead at 5:55 a.m. of that day. Benton County Deputy Coroner Nicole Lee contacted the Richmond Police Department due to the circumstances of the baby’s death and officers were dispatched to the facility.

In his initial interview with investigators, Olivo reportedly claimed that his son was sleeping on her lap while he watched videos on his phone. He began to fall asleep and accidentally dropped the phone which hit the boy on the temple, according to the report.

Olivo reportedly claimed that he woke up at 5 a.m. that morning and found that his son was not breathing, so he performed CPR and the baby vomited what appeared to be blood. The girl’s mother had reportedly been sleeping since 11 p.m. the previous night.

Olivo was not immediately arrested, but police questioned him again after an autopsy by the Snohomish County Medical Examiner’s Office found the newborn had a “linear fracture on the right side of the skull, bleeding under the entire skull. scalp, diffuse subdural hematoma, multiple anterior and posterior rib fractures (to include several that were broken in two places) and a lacerated liver, ”reported Yakima CBS affiliate KIMA-TV.

In the post-autopsy interview, Olivo reportedly told investigators that he had tried to be a good parent in the first weeks of his baby’s life, but said at some point he “didn’t care anymore” and started to intentionally harm the crying baby.

Court documents reportedly detailed that Olivo told police that he initially pulled his son’s hair and ears “to cause him pain” and spanked him every time his diaper was changed, often hitting “the part lower back with a flat hand. ” ”

“Jose said that he understood that what he was doing was causing him pain, yet he said that he did not know that he would cause an injury,” according to the court documents. “José said that the night before JR’s death, he was responsible for JR all night and became increasingly frustrated with JR’s crying.”

The ruthlessly cruel treatment allegedly only grew more malicious, and Olivo reportedly admitted that he “found himself throwing his youngest child into his crib from a height above his stomach and chest”, according to KIMA-TV. Olivo reportedly threw the baby to spin in the air “like a soccer ball” so that he “made sure [the child’s] head hit the back rail of the crib.” The victim would then land in the crib that was filled with toys and objects that Olivo said would be painful to land on.

KIMA-TV further reported that Olivo told police that he began squeezing his son when he was about 3 weeks old because he was “frustrated.” He allegedly said that he squeezed the child “every day” and many times with force “so hard that his shoulders ached from the force he applied to his son.” At least once, the child stopped breathing for a period of time.

Olivo reportedly said that he would wait for the baby’s mother to fall asleep before beginning the ritual abuse of her son.

In the indictment documents, Assistant District Attorney Brian Hultgrenn allegedly wrote that Olivo “engaged in a pattern or practice of assault or torture” in circumstances that “manifest an extreme disregard for human life.”

Olivo is currently being held in the Benton County Jail on a $ 500,000 bond.
