Leo Christopher Kelly is charged in the U.S. District Court for the District of Columbia with knowingly entering or remaining in any building or restricted land without legal authority and trespassing with the intent to disrupt the orderly conduct of official business and the disorderly conduct on the Capitol grounds.

He also acknowledged that it should be an “absolute last resort,” according to the affidavit. “Maybe we shouldn’t have done that … It’s just that you reach the end of your rope and get carried away by a movement.”

Investigators identified it as part of the pandemonium through video coverage by a news reporter and through two interviews he did with The Gazette and the LifeSiteNews website, according to an affidavit filed with the complaint on Friday.

In this video interview with LifeSiteNews, which describes himself as opposed to abortion rights, Kelly said that he was “one of the first men to violate the Capitol building and enter with dozens of people.”

The affidavit says Kelly, in that interview, also said that he stayed inside the Capitol for 30 minutes to an hour. He claimed that the invaders did not meet with law enforcement officials and said he and others were “mostly respectful as you can be when you are really pushing someone’s space in that way,” the affidavit said.

He admitted that he made it to the Senate floor and said a prayer with others, according to the affidavit.

His interview concluded with a video that Kelly probably recorded on his cell phone from the Senate “during the insurrection,” the affidavit says.

Kelly, in the LifeSiteNews interview, told an interviewer that he took a video and shows desks that were open and in disarray and other people involved in the invasion that day, according to the affidavit.

A video shot by New Yorker Magazine’s Luke Mogelson also showed the scene unfolding on the Senate floor at the time of the raid.

In the New Yorker video, Kelly can be seen inside the chamber beginning at approximately 7:55 on the footage.
