Charged – Arrested
Locke told investigators he was “watching television and monitoring his outdoor surveillance cameras” when he saw someone steal his neighbor’s car across the street, according to an arrest report obtained by The Post.
Locke walked into his garage and then grabbed a gun before yelling at the teen as he stood in his own driveway to make sure he wasn’t his neighbor, deputies said.
The teen then turned to Locke as he held a flashlight and possibly dropped something, leaving the owner unsure whether the robbery suspect had “some kind of weapon,” according to the arrest report.
Locke then put a bullet in his pistol when the suspect then began to walk away from him, telling officers that he was “momentarily distracted” at one point while he made sure the suspected thief was alone, officers said.
The suspect then stopped and directed his flashlight at Locke, who told officers that he opened fire because he believed the teenager “would possibly approach him,” according to the arrest report.
“Victim 1 collapsed on the ground and said something like ‘help me,'” the report says, adding that Locke went back inside and called police.
Locke, who was charged with aggravated battery with a firearm, told investigators that he only saw a flashlight in the teen’s hands, and not a weapon. He decided to shoot the alleged thief out of “fear” that the teenager would attack him, according to the report.
“However, according to [Locke’s] post-Miranda statement, [the teenager] never made overt or hostile statements or actions toward him to put him in well-founded fear,” the deputies wrote.
The teenager, also from Gainesville, suffered a single gunshot wound to the back that required surgery and was in intensive care at a hospital, according to the arrest report.
“He is intubated and cannot give a statement,” the deputies wrote.
Locke shot the alleged thief after he strayed a bit from him, but it’s unclear exactly how far away he was from the 16-year-old at the time, Alachua County Sheriff’s Office spokeswoman Capt. Kaley Behl said.
“He was not defending his own home,” Behl told The Post, adding that investigators did not view the shooting as an act of self-defense. “It was his neighbor’s car.”
